International legal standoff escalates: On Monday, April 14, during a meeting in the Oval Office, U.S. President Donald Trump and El Salvador’s President Nayib Bukele made it clear that Kilmar Armando Abrego Garcia, a Maryland resident who was wrongfully deported to El Salvador, would not be returned to the United States.

 

This decision comes despite a U.S. Supreme Court ruling that mandates the federal government to “facilitate” Abrego Garcia’s return. White House officials argue that while the ruling requires facilitation, it does not compel El Salvador to comply. When CNN’s Kaitlan Collins directly asked President Bukele if he would return Abrego Garcia, he rejected the idea.

“I hope you’re not suggesting that I smuggle a terrorist into the United States,” Bukele said. “How can I smuggle a terrorist into the United States? Of course I’m not going to do it. The question is preposterous.”

 

The Supreme Court’s brief, unsigned decision upheld an earlier order by U.S. District Judge Paula Xinis, which required the U.S. government to take steps to return Abrego Garcia. However, the justices clarified that the government must “facilitate” the return but is not obligated to “effectuate” it—a distinction with significant implications.

 

Senior White House officials have criticized Judge Xinis’ order, claiming it interferes with the executive branch’s authority over foreign policy. Recently, President Trump has adjusted his stance. Initially stating that he would respect the Supreme Court’s ruling, he has since aligned with the White House’s interpretation.

 

“If the Supreme Court said bring somebody back, I would do that. I respect the Supreme Court,” Trump said last week, though he has not taken action to enforce the decision.

 

Abrego Garcia reportedly entered the U.S. illegally around 2011. In 2019, an immigration judge ruled that he should not be deported due to credible threats from a gang in El Salvador targeting his family’s pupusa business. Despite this ruling, he was later deported under controversial circumstances.
