Defamation Suit Worth N1bn Filed by Femi Falana and Falz Against VeryDarkMan Struck Out

VeryDarkMan legal victory:  A Lagos High Court sitting in Ikeja on Tuesday, April 15, dismissed the defamation lawsuit filed by Femi Falana and his son, Folarin Falana (popularly known as Falz), against online commentator Martins Otse, also known as VeryDarkMan (VDM).

The Falanas had filed the suit following comments and a video VDM shared on his social media platforms on September 24, 2024. In the video, he accused them of accepting N10 million from Idris Okuneye, a.k.a. Bobrisky, to obstruct justice.

They each demanded N500 million in damages through separate lawsuits.

During the court session on April 15, none of the parties—the Falanas or VDM—were present.

VDM’s lawyer, Niyi Alagbe, standing in for Marvin Omorogbe, informed the court of an earlier application for a stay of proceedings filed before Justice Fimisola Azeez.

In response, the Falanas’ lawyer, Omotayo Olatunbosun, acknowledged receiving the application the previous day around 4:15 p.m., but argued that the preliminary objection was scheduled for hearing and that the new filing was simply a tactic to delay proceedings. He urged the court to move forward.

However, Justice Matthias Dawodu noted that the new application was not included in the court’s file and questioned why he was being asked to proceed with the matter when the main case was already before another judge.

He then ruled to strike out the case, stating that continuing with it would be a mere academic exercise under the circumstances.

“Accordingly, this suit is hereby struck out,” he declared.
