Decision on Trans Women: J.K. Rowling has spoken out following the UK Supreme Court’s ruling on the legal definition of a woman, expressing her pride in the “tenacious Scottish women” who fought for the case to be heard.
On April 16, 2025, the court delivered a landmark judgment, siding with the feminist group For Women Scotland and against the Scottish Government. The panel of five judges ruled that in the context of the Equality Act, the term “woman” refers specifically to a “biological woman” and biological sex.
The ruling was a victory for feminist campaigners who had long argued that the legal definition of a woman should apply only to those born female, excluding trans women from the category.
Following the judgment, Rowling took to X (formerly Twitter) to share her support: “It took three extraordinary, tenacious Scottish women with an army behind them to get this case heard by the Supreme Court and, in winning, they’ve protected the rights of women and girls across the UK. For Women Scotland, I’m so proud to know you.”
The 88-page ruling, delivered by Supreme Court judges Lord Hodge, Lady Rose, and Lady Simler, reinforced the idea that “the concept of sex is binary” and that a person is either a woman or a man. The court unanimously agreed that the Equality Act 2010’s definition of “woman” refers specifically to biological women. However, the judges also affirmed that the law continues to protect trans individuals from discrimination.
The case marks the culmination of a three-year legal battle, which sparked widespread debate about trans rights and the protection of women’s spaces. The ruling has been seen by many as a victory for women’s rights, while also maintaining legal protections for trans people.
Still no Decision on Trans Women
The debate has been particularly heated since 2020, when J.K. Rowling publicly opposed the trend of replacing “biological sex” with “gender identity.” Her comments, which included the assertion that “sex is real,” sparked outrage from trans rights activists and resulted in death threats. Despite this, Rowling became a leading figure in the “gender-critical” movement.
Trina Budge, director of For Women Scotland, hailed the ruling as a significant win for women’s rights, stating: “This case was always about women, never about trans rights, who, as Judge Hodge said, are fully protected in law still, but now we have clarity over what a woman means in law.”
