The Federal Competition and Consumer Protection Commission (FCCPC) has stated that Meta’s decision to quit Nigeria will not absolve the company of liability.

FCCPC On Meta Exit: The Federal Competition and Consumer Protection Commission (FCCPC) has responded sharply to Meta Platforms Inc., warning the tech giant that its threat to exit Nigeria will not exempt it from legal responsibilities or liabilities under Nigerian law.

Meta had announced earlier on May 3 that it “may be forced to effectively shut down Facebook and Instagram services in Nigeria” to mitigate the risk of enforcement actions. This warning followed Meta’s unsuccessful attempt to overturn a ₦220 million fine imposed by the FCCPC for violations of data protection and consumer rights laws.

In response, the FCCPC described Meta’s statement as a “calculated” move intended to provoke a negative public reaction and pressure the FCCPC to reconsider its decision.

The commission emphasized that Meta’s threat to leave Nigeria does not absolve it from liability in the judicial process.

“These infringements included denying Nigerians the right to control their personal data, transferring and sharing Nigerian user data without authorization, discriminating against Nigerian users compared to users in other jurisdictions, and abusing their dominant market position by imposing unfair privacy policies,” the FCCPC wrote on X.

The commission also highlighted that Meta had faced similar penalties elsewhere, including a \$1.5 billion fine in Texas and a \$1.3 billion penalty in the European Union for data privacy violations. Meta has also been penalized in India, South Korea, France, and Australia for similar breaches but did not threaten to exit those countries.

FCCPC concluded by stressing that Meta complied with regulations in other nations, stating, “But Meta never resorted to the blackmail of threatening to exit those countries. They obeyed.”
